The Fences Act 1968
The Fences Act 1968 provides that any person desiring to compel any other person to construct or contribute to the construction of a dividing fence may serve a notice to fence on the other person. This may require the use of personal property information to serve the notice. To enable the council to provide this information, a written request must be made and must indicate the address, if known, of the neighbouring property or properties. If the request is by a fencing contractor, the contractor must provide written evidence that they are authorised to act on behalf of the property owner.
The Building Act 1993 (Part 7, Section 84)
The Building Act 1993 (Part 7, Section 84) determines that an owner who is required by the building regulations to carry out protection work in respect of an adjoining property before or during the carrying out of building work for which a building permit is required, before commencing the building work, serve on the owner of the adjoining property and the relevant building surveyor notice of the proposed building work.
Siting Dispensation (Building Regulations 2006)
Property owners may seek a dispensation(s) via a report and consent for proposed building work that is a variance from the requirements of the Building Regulations 2006 (e.g. a building is closer to a front boundary than allowed under the Regulations). When this occurs comments must be sought from the adjacent property owner(s) in relation to the siting dispensation(s). This may require the use of personal property information to seek the comment.

Accordingly, the council is committed to full compliance with its obligations under the Privacy and Data Protection Act

Under the Freedom of Information Act 1982 (Vic) (FOI Act), every person has the right to request access to documents held by Victorian public sector agencies and Ministers. This right of access is subject to exceptions and exemptions necessary to protect essential public and private interests.
